MagnAct QR Code Platform – Terms & Conditions

Welcome to the MagnAct QR Code Platform. By using our QR menu and digital menu services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the platform.

1. Scope of Service

MagnAct QR Code provides a digital platform for:

• Electronic menus

• QR code generation for restaurants

• Menu item and pricing management

• Digital menu display for customers

• Related digital menu solutions

The platform does not include payment processing or delivery services unless agreed separately.

2. User Account

• An account is required to use the platform.

• The client is responsible for keeping login credentials confidential.

• The client is fully responsible for all activity under their account.

3. Menu Content Responsibility

• The client is fully responsible for the accuracy of menu content, including prices, descriptions, images, and allergen information.

• MagnAct is not responsible for errors in client-provided content.

• The client agrees not to upload any illegal or inappropriate content.

4. Service Availability

MagnAct aims to provide continuous access to the platform but does not guarantee uninterrupted service due to:

• Scheduled maintenance

• Technical updates

• Unforeseen system issues

5. Subscriptions and Payments

• Certain features may require paid subscriptions.

• The client agrees to pay all applicable fees based on the selected plan.

• Fees are non-refundable unless otherwise agreed in writing.

6. Intellectual Property

All software, systems, interfaces, designs, and QR code technologies provided by MagnAct are the exclusive property of MagnAct and may not be resold, copied, or used outside the platform without written permission.

7. Limitation of Liability

MagnAct shall not be liable for:

• Loss of profits

• Business interruption

• Order errors caused by menu content

• Any indirect or consequential damages arising from platform use

8. Account Suspension or Termination

MagnAct reserves the right to suspend or terminate accounts in cases of:

• Platform misuse

• Violation of these terms

• Illegal or abusive activities

9. Platform Modifications

MagnAct reserves the right to update, modify, or enhance platform features to improve performance or add new functionalities.

10. Governing Law

These Terms & Conditions shall be governed by the applicable laws of the jurisdiction in which MagnAct operates or as agreed with the client.

مرحبًا بك في منصة MagnAct QR Code. باستخدامك لمنصتنا الخاصة بالمنيو الإلكتروني وأنظمة QR، فإنك توافق على الالتزام بهذه الشروط والأحكام. في حال عدم موافقتك على أي جزء من هذه الشروط، يرجى عدم استخدام المنصة.

1. نطاق الخدمة

توفر منصة MagnAct QR Code نظامًا رقميًا لإنشاء وإدارة:

• المنيو الإلكتروني

• رموز QR الخاصة بالمطاعم

• إدارة الأصناف والأسعار

• عرض المحتوى الرقمي للعملاء

• حلول رقمية مرتبطة بقائمة الطعام

ولا تشمل المنصة معالجة الدفع أو توصيل الطلبات ما لم يتم الاتفاق على ذلك بشكل منفصل.

2. حساب المستخدم

• يجب على العميل إنشاء حساب لاستخدام المنصة.

• يتحمل العميل مسؤولية الحفاظ على سرية بيانات الدخول.

• يتحمل العميل كامل المسؤولية عن أي نشاط يتم عبر حسابه.

3. محتوى المنيو

• العميل مسؤول بالكامل عن صحة محتوى المنيو (الأسعار، الوصف، الصور، المكونات، الحساسية الغذائية، إلخ).

• لا تتحمل MagnAct أي مسؤولية عن أي أخطاء في محتوى المنيو المدخل من قبل العميل.

• يلتزم العميل بعدم نشر أي محتوى مخالف للقوانين أو الآداب العامة.

4. توفر الخدمة

تسعى MagnAct إلى توفير المنصة بشكل مستمر، ولكن لا تضمن عدم حدوث انقطاعات مؤقتة بسبب:

• الصيانة الدورية

• التحديثات التقنية

• أعطال خارجة عن السيطرة

5. الاشتراكات والدفع

• قد تكون بعض الميزات مدفوعة ضمن باقات اشتراك.

• يلتزم العميل بدفع الرسوم المتفق عليها وفق الباقة المختارة.

• لا يتم استرداد الرسوم إلا في حال وجود اتفاق خطي منفصل.

6. الملكية الفكرية

جميع الأنظمة، البرمجيات، الواجهات، التصاميم، ورموز QR التي توفرها MagnAct هي ملك حصري للشركة، ولا يجوز إعادة بيعها أو نسخها أو استخدامها خارج نطاق المنصة دون إذن خطي.

7. حدود المسؤولية

لا تتحمل MagnAct أي مسؤولية عن:

• خسائر الأرباح

• توقف الأعمال

• أخطاء الطلبات الناتجة عن محتوى المنيو

• أي أضرار غير مباشرة ناتجة عن استخدام المنصة

8. إيقاف أو إنهاء الحساب

تحتفظ MagnAct بحق إيقاف أو إنهاء الحساب في حال:

• إساءة استخدام المنصة

• مخالفة هذه الشروط

• استخدام المنصة في أنشطة غير قانونية

9. التعديلات على الخدمة

تحتفظ MagnAct بحق تطوير أو تعديل ميزات المنصة في أي وقت لتحسين الأداء أو إضافة وظائف جديدة.

10. القانون المعمول به

تخضع هذه الشروط للقوانين المعمول بها في الدولة التي تعمل فيها MagnAct أو وفقًا للاتفاق المبرم مع العميل.
